This Terms of Use (“Terms”) govern the contractual relationship between you and Brotek Teknoloji Anonim Şirketi, located at Esentepe Mahallesi Büyükdere Caddesi No:175/7 Kat:B4 34360 Şişli/İstanbul, together with its affiliates and subsidiaries (collectively “COENSIO”, the “Company”, or “we”), regarding your use of the coens.io website, web applications, mobile interfaces, software infrastructure, servers, and all technical systems integrated therein (“Platform”), as well as all related services.
By accessing the Platform, creating an account, or using the services in any manner, you acknowledge that you have read, understood, and agree to these Terms as a “User.”
If you access or use the Service on behalf of another person or entity (e.g., a company), you represent and warrant that you are authorized to accept these Terms on their behalf and that your acceptance binds the relevant person or entity to these Terms.
COENSIO reserves the right to modify, update, or revise these Terms at any time without notice. The current version of the Terms is effective as soon as it is published on the Platform. Your continued use of the Platform constitutes acceptance of the updated Terms.
If you do not agree to these Terms, you are not authorized to access or use the Service and must immediately cease any use of the Service.
1.1. COENSIO provides technological services such as candidate assessment tests, video interview solutions, AI-powered analytics tools, inventories, reporting systems, and similar services for the digital management of human resources processes (“Service”).
1.2. Services offered via the Platform may be developed, expanded, or limited over time. COENSIO reserves the right to make changes to the technical infrastructure, operation, and content of the services. Users acknowledge that such changes are a natural part of the Service.
1.3. COENSIO makes reasonable efforts to provide the Service in accordance with these Terms and Turkish law, using qualified personnel and with reasonable care, skill, and diligence.
1.4. The Service provided by COENSIO is non-exclusive, and these Terms do not prevent COENSIO from offering the Service to third parties.
1.5. The Service may integrate with third-party services via web services and APIs. No guarantee is provided regarding their availability. COENSIO may discontinue such services if the third-party provider ceases to offer them or does not provide them under reasonable conditions. Users cannot claim refunds or compensation in such cases.
1.6. COENSIO is not responsible for issues arising from the User’s device, internet connection, or third-party services during Platform use.
2.1. Users agree to use the Platform in compliance with applicable laws, ethics, integrity, and these Terms.
2.2. Users are solely responsible for all actions and content shared on the Platform.
2.3. Users shall not engage in activities that disrupt the Platform, compromise its security, or interfere with other users’ access.
2.4. Users shall not use the Platform for unlawful, unfair, or abusive purposes.
2.5. Users are responsible for providing, maintaining, and paying for all hardware, telecommunications, and other services necessary to use the Platform.
3.1. Users are granted a limited, non-exclusive, non-transferable, and non-sublicensable right to access the Platform and use the Service. This right is limited to the contract term and subscription scope and does not transfer ownership.
3.2. Users shall use the Platform only within their internal business processes, in compliance with applicable laws, public order, and general morality. The User is prohibited from granting third parties access to the Platform, leasing, reselling, or offering it as a service.
3.3. Unauthorized access attempts, interference with systems, or actions that cause data breaches are prohibited.
3.4. Users shall not use software that may harm the Platform, spread viruses, or disrupt its operation.
3.5. Copying, reproducing, modifying, reverse-engineering, or using any part of the Platform for commercial purposes without permission is prohibited.
3.6. Users shall not use the Platform to develop products or services that compete with COENSIO.
3.7. Using the Platform for illegal purposes, uploading content that violates third-party rights, or performing misleading, discriminatory, or abusive actions is prohibited.
3.8. Violations may result in suspension or termination of the Service by COENSIO.
4.1. All software, algorithms, designs, databases, trademarks, trade names, logos, designs, information, methods, and other intellectual and industrial property rights related to the Platform belong to COENSIO and are protected under applicable law.
4.2. Users may not engage in activities that infringe these rights. Unauthorized use, reproduction, or commercial exploitation of the Platform may lead to civil and criminal liability.
4.3. Use of the Platform does not grant Users any rights regarding these intellectual property rights.
5.1. If a User registers an account, the security of account credentials (e.g., username and password) is entirely the User’s responsibility. Users agree not to share credentials and to implement necessary security measures.
5.2. All actions taken via an account are deemed to be performed by the User. In cases of unauthorized access, account compromise, or security breaches, Users must notify COENSIO immediately.
6.1. Personal data on the Platform is processed in compliance with applicable laws. Detailed information on personal data processing is available in the Privacy Notice on the Processing of Personal Data.
6.2. Users represent and warrant that they have fulfilled all obligations under Law No. 6698 on the Protection of Personal Data and related legislation.
7.1. The Platform is provided “as-is” and “as-available,” with no guarantee of uninterrupted, error-free service or any specific performance level.
7.2. Planned maintenance, technical updates, third-party infrastructure interruptions, or force majeure events may cause service disruptions. COENSIO is not responsible for such events.
7.3. COENSIO may modify infrastructure and systems to improve service quality.
These Terms are governed by the laws of the Republic of Turkey. In case of disputes, the Istanbul Anatolian and Istanbul Central (Çağlayan) Courts and Enforcement Offices have exclusive jurisdiction.
